These Terms & Conditions (“Terms”) govern your access to and use of the Plant1 website (“site”) and any purchase of products/services offered on it. By accessing the site or placing an order, you agree to be bound by these Terms, along with our Privacy Policy, Refund/Returns & Cancellation Policy, Shipping Policy, and any other policies shown on the site.

1) Privacy

Please review our Privacy Policy to understand how we collect, use, and protect your personal information.

2) Payment Policy

Payments, payment methods, and payment-related terms are governed by our Payment/Checkout Policies shown on the site and/or at checkout.

3) Products for Personal Use Only

Plant1 products and services sold on this site are intended for personal, noncommercial use unless explicitly stated otherwise. You may not resell products purchased from the Site without prior written permission from Plant1.

4) Product Use, Outcomes & User Responsibility

Plant1 devices and inputs are designed to assist plant care, but results may vary based on plant type, environment, light, water quality, and usage conditions that are outside our control. You agree that you use products as per instructions and accept responsibility for storage, handling, installation, and operation.

5) Accuracy of Information

We strive to ensure product descriptions, specifications, pricing, images, and other content are accurate. However, content may occasionally contain errors or commissions (including pricing/availability). To the extent permitted by law, Plant1 does not warrant that all content is complete, current, or error-free. 

6) Intellectual Property

All content on the site i.e. logos, trademarks, product names, text, graphics, images, videos, designs, UI, and “look and feel” belongs to Plant1and/or its licensors and is protected under applicable laws. Plant1 is a registered trademark of GreenGraffiti Private Limited. You may not copy, reproduce, distribute, modify, sell, or exploit any Site content without Plant1’s prior written consent, except where expressly permitted by law.

7) Your Obligations & Acceptable Use

When using the site, you agree to:
• Follow applicable laws and act in good faith
• Not interfere with site security, availability, or functionality
• Not misuse the site for fraudulent, abusive, or harmful activity
If you violate these Terms, you may be responsible for losses/damages caused to Plant1 and/or third parties.

8) Orders, Limits & Right to Refuse

Plant1 may, at its discretion and with or without notice:
• Limit quantities purchased per order/customer/address
• Cancel or refuse any order suspected to be fraudulent, unauthorized, or in
breach of these Terms

Order acceptance occurs only after successful payment (or COD confirmation, if offered) and dispatch confirmation.

9) User Content

If you submit reviews, photos, videos, comments, or other content (“User Content”), you are solely responsible for it. You agree not to upload or share content that is unlawful, misleading, abusive, harassing, infringing, or that violates others’ privacy/rights, and not to impersonate or misrepresent affiliations. Plant1 may remove or refuse User Content at its discretion.

10) Copyright / IP Complaints

If you believe any content on the Site infringes your copyright or intellectual property,
please email: onecare@plant1.in with:
• Identification of the copyrighted work
• The exact URL/location of the allegedly infringing material
• Your contact details and authority to act
We will review and take appropriate action.

11) Consent to Receive Notices Electronically

You consent to receive communications from us electronically (email, WhatsApp/SMS where applicable, or notices posted on the Site). These communications satisfy legal requirements of “in writing.” You may withdraw consent by emailing onecare@plant1.in and discontinuing Site use, but some services may not be available without electronic communication.

12) Changes to These Terms

We may update these terms from time to time by posting revised terms on the site. Changes become effective upon posting. Continued use of the Site after updates means you accept the updated Terms.

13) Termination

We may suspend or terminate access to the site or services if we believe you have violated these Terms or applicable law. On termination, you must stop using the site and any rights granted under these Terms will cease.

14) Limitation of Liability

To the maximum extent permitted by law, Plant1 is not liable for indirect, incidental, special, or consequential damages. Where liability cannot be excluded, liability will be limited to the amount paid for the specific order giving rise to the claim, unless law requires otherwise.

15) Governing Law & Jurisdiction

These terms are governed by the laws of India and shall have jurisdiction, subject to consumer protection laws.

16) Severability & No Waiver

If any provision is held unenforceable, the remainder will remain in effect. Failure to enforce any provision is not a waiver of our right to enforce it later.
