These Terms of Service ("Terms") govern your access to and use of the Plant1 website (“site”, "website") and any purchase of products/services offered on it. By accessing the site or placing an order, you agree to be bound by these Terms, along with our Privacy Policy, Refund/Returns & Cancellation Policy, Shipping Policy, and any other policies shown on this website. Plant1 is a referred as “Plant1”, “we”, “us” or “our” throughout Plant1 website.

3. Products for Personal Use Only

Plant1 products and services sold on this site are intended for personal, noncommercial use unless explicitly stated otherwise. You may resell products purchased from the our website only after granted written permission from Plant1 or from GREENGRAFFITI Private Limited. The products sold on this website, and any samples thereof we may provide to you, are for personal use only. You may not sell or resell any of the products, or samples thereof, you receive from us.

We reserve the right, with or without notice, to cancel or reduce the quantity of any products to be provided to you that we believe, in our sole discretion, may result in the violation of our Terms and Conditions.

4. Accuracy of Information

We attempt to be as accurate as possible when describing our products on the website. However, except to the extent implied by applicable law, we do not warrant that the product descriptions, colours, information or other content available on the website are accurate, complete, reliable, current, or error-free.

5. Product Use, Outcomes & User Responsibility

Plant1 products are designed to assist plant care, but results may vary based on plant type, environment, light, water quality, and usage conditions that are outside our control. You agree that you use products as per instructions and accept responsibility for storage, handling, installation, and operation.

6. Plant1 dharā Warranty Terms

6.1 Our Warranty Promise

Every Plant1 dharā is thoughtfully made for effortless indoor greenery.

Plant1 offers a 1-year limited manufacturer warranty on the Plant1 dharā Smart Planter, beginning from the date of original purchase. This warranty covers manufacturing defects in the product when it is used and maintained according to the instructions in the user manual.

The warranty is available only to the original purchaser and is non-transferable.

6.2 Warranty Registration

To activate and claim warranty support, please register your Plant1 dharā within 30 days of purchase.

You will need:

Proof of purchase or invoice
Product serial number
Registered customer details

Keep your proof of purchase safely, customer details

Keep your proof of purchase safely, as it may be required to verify a warranty claim.

6.3 What is Covered

Under normal indoor use, Plant1 will repair or replace the affected product or component if a manufacturing defect is found in:

The OxyFlow™ pump and water-circulation system
LED indicators and internal electronic components
The USB-C power adapter supplied in the box

Repair or replacement will be determined by Plant1 after inspection of the product or the reported issue.

6.4 What is Not Covered

This limited warranty does not cover issues caused by misuse, improper care, accidental damage, or use outside the recommended guidelines.

The warranty will not apply in cases of:

Water entering electronic components due to immersion, liquid spills, or improper use.
Using garden soil, non-Plant1 nutrients, or unsuitable growing media.
Operating dharā without water in the reservoir.
Filling water above the maximum water-level indicator.
Physical damage, drops, cracks, dents, or accidental breakage.
Damage caused by improper handling, neglect, or failure to follow the user manual.
Tampering, unauthorized repairs, alterations, or modifications.
Use of non-approved third-party accessories that cause damage to the product.
Missing, altered, damaged, or unreadable serial numbers.
Normal wear and tear, cosmetic marks, discoloration, or changes in appearance that do not affect product function.
Plant health, plant loss, pest infestation, fungal issues, or results affected by light, temperature, placement, plant type, nutrients, or other environmental conditions.

6.5 Important Use Conditions

For safe and reliable operation, please:

Use dharā indoors on a stable, flat surface.
Use only with clean water and within the maximum water-level mark.
Keep the device connected to a suitable 5V USB-C power supply.
Do not immerse the device in water.
Follow the cleaning, maintenance, nutrient, and watering guidance in the user manual.
Use Plant1 recommended nutrients and growing media for the intended soil-free growing routine.

6.6 Warranty Claim Process

To request warranty support, visit https://plant1.in/pages/register with:

Your name and registered contact details
Product serial number
Date and proof of purchase
A clear description of the issue
Photos or a short video showing the issue, alert light, or unusual behaviour, where possible

Our team may guide you through basic troubleshooting before arranging a repair, replacement, or further inspection.

6.7 Limitation of Warranty

This warranty covers manufacturing defects in Plant1 dharā only. It does not guarantee a particular plant-growth outcome, as plant health can depend on factors such as plant variety, light, temperature, nutrient routine, water quality, and placement. Nothing in these Warranty Terms limits rights that may be available to you under applicable consumer-protection laws.

6.8 Updates to These Terms

Plant1 may update these Warranty Terms from time to time. The warranty terms applicable to your product will be the terms in effect on the date of your original purchase.

7. Intellectual Property

All information and content available on the website and its “look and feel”, including but not limited to trademarks, logos, service marks, text, graphics, logos, button icons, images, audio clips, data compilations and software, and the compilation and organization thereof (collectively, the “Content”) is the property of Plant1, our Affiliates, partners or licensors, and is protected by laws of India, including laws governing all applicable forms of intellectual property.

Plant1 is a registered trademark of GREENGRAFFITI Private Limited. You may not copy, reproduce, distribute, modify, sell, or exploit any of the website content without Plant1’s prior written consent, except where expressly permitted by law.

8. Your Obligations & Acceptable Use

When accessing or using the Plant1 website, you shall comply with:
• Follow applicable laws and act in good faith.
• Not interfere with website security, availability, or functionality.
• Not misuse the website for fraudulent, abusive, or harmful activity.

Without limiting the generality of any other provision of these Terms and Conditions, if you default negligently or willfully in any of the obligations set forth in these Terms and Conditions, you shall be liable for all the losses and damages that this may cause to Plant1, our Affiliates, Partners or Associates.

9. Orders, Purchase Limits & Right to Refuse

All orders placed on Plant1 are subject to availability, verification and acceptance by Plant1. We reserve the right to limit quantities purchased per order, customer, household, payment method or delivery address, including where an order appears to be placed for commercial resale.

Plant1 may refuse, place on hold or cancel any order, in whole or in part, if we reasonably believe that it:

is fraudulent, unauthorized or placed using inaccurate information;
involves a payment, address, account or delivery-related concern;
is intended for resale, redistribution or other unauthorized commercial use;
results from a pricing, promotional, stock, product-description or technical error; or
breaches these Terms or applicable law.

If an order is cancelled after payment has been successfully collected, the applicable amount will be refunded to the original payment method in accordance with our Refund Policy. Any bank or payment-provider processing timelines may apply.

An order confirmation, payment authorization or Cash on Delivery confirmation only acknowledges that we have received your order. Your order is accepted only when the product is dispatched and Plant1 issues the dispatch confirmation.

10. User Content

If you submit or share reviews, ratings, photographs, videos, comments, testimonials, social-media tags or any other material relating to Plant1 (“User Content”), you remain responsible for that content and must ensure that you have the necessary rights, permissions and consent to share it.

You must not submit User Content that is false, misleading, unlawful, defamatory, offensive, abusive, discriminatory, threatening, sexually explicit, or otherwise inappropriate. You must not upload content that infringes another person’s intellectual-property, privacy, publicity or other legal rights, contains personal information without permission, impersonates another person, or falsely suggests an affiliation with Plant1.

By submitting User Content, you grant Plant1 a non-exclusive, worldwide, royalty-free, transferable and sublicensable licence to use, reproduce, adapt, publish, display, distribute and share that User Content for operating, promoting and marketing Plant1 and its products across our website, social-media channels, advertising and other brand communications. This licence continues unless you request its withdrawal in writing and we are reasonably able to remove the relevant content from future use.

Plant1 may, but is not required to, review, moderate, refuse, edit or remove User Content at any time, without notice.

11. Consent to Receive Notices Electronically

By using the Plant1 website, creating an account, placing an order or otherwise providing your contact details to Plant1, you consent to receive communications from us electronically. These may include emails, SMS, WhatsApp messages (where applicable), order updates, invoices, service notifications, policy updates and notices posted on the Site.

You agree that electronic communications from Plant1 satisfy any legal requirement that such communications be provided in writing, to the extent permitted by applicable law.

You may withdraw consent for promotional communications at any time by using the unsubscribe option in the message, replying as instructed, or contacting us at onecare@plant1.in. However, you may continue to receive essential transactional communications relating to your account, orders, payments, deliveries, returns, warranty or other services you have requested. Withdrawal of consent for essential communications, or discontinuing use of the Site, may limit our ability to provide certain services.

12. Copyright / IP Complaints

Plant1 respects the intellectual-property rights of others. If you believe that any content on the website infringes your copyright, trademark or other intellectual-property rights, please email onecare@plant1.in with:

a clear description of the work or right you believe has been infringed;
the exact URL or location of the allegedly infringing material;
your full name, contact details and relationship to the rights holder;
documents or information supporting your ownership of, or authority to act for, the relevant rights; and
a statement that the information provided is accurate and that you have a good-faith belief that the use is unauthorized.

We may review the request, seek further information and take action we consider appropriate, including removing or restricting access to the relevant content.

13. Changes to These Terms

Plant1 may revise these Terms from time to time to reflect changes to our products, services, business practices, legal requirements or the website. Changes take effect when posted. Your continued use of the website or purchase of products after the updated Terms take effect constitutes your acceptance of those changes.

14. Termination

Plant1 may suspend, restrict or terminate your access to the site, account, services or any order, where we reasonably believe that you have breached these Terms, provided inaccurate information, engaged in fraudulent or unlawful activity, misused the Site, or created a risk of harm to Plant1, its customers or third parties.

Upon termination, you must stop using the website and any rights or permissions granted to you under these Terms will immediately cease. Termination does not affect rights or obligations that arose before the termination date, including payment obligations, intellectual-property rights, limitations of liability and dispute-related provisions.

15. Limitation of Liability

To the maximum extent permitted by law, Plant1 is not liable for indirect, incidental, special, or consequential damages. Where liability cannot be excluded, liability will be limited to the amount paid for the specific order giving rise to the claim, unless law requires otherwise.

16. Governing Law & Jurisdiction

These terms are governed by the laws of India and shall have jurisdiction, subject to consumer protection laws.

17. Severability & No Waiver

If any provision is held unenforceable, the remainder will remain in effect. Failure to enforce any provision is not a waiver of our right to enforce it later.
